Landlord and Tenant Act "Pets"

For years now, I have come across a lot of various topics relating to renting. In Brampton and Mississauga, there are a variety of options on how to rent a property.  Some concerns in which I have dealt and heard about include: basement apartments (legal/illegal), mortgage fraud, first time home buyers and much more.

A topic of major concern is the fact regarding Landlords and Tenant rights. Many families and single professionals like the aspect of renting vs. buying.  With renting you are able leave after a minimum of 1 year. You may have amenities like, cardio room, saunas, weight room, party room, theatre room, virtual golf, and more. Or if you are renting the whole house, well in that case you are responsible for a variety of aspects.

However, I am concerned about the lack of knowledge that Landlords and Tenants have when renting. Prime example, is the aspect of allowing pets. Under the Landlord and Tenant Act, a Landlord can't discriminate against anyone who has a pet. Click here for the Landlord and Tenant Act.

Here is the actual clause from the act. Go under The Law topic on the left hand side; click the link, then click Residential Tenancies Act:

“No pet” provisions void
14. A provision in a tenancy agreement prohibiting the presence of animals in or about the residential complex is void. 2006, c. 17, s. 14.  So, what this is stating that when doing an Agreement to Lease, having an animal is allowed in a dwelling.

The exception to this rule can be Condominiums. Within the Condominium Corporation, they have a declaration outlying the rules and regulations for the unit owners. This declaration varies from each Condominium Corporation. Knowing the by-laws prior to signing any Agreement to Lease, is vital if you have a pet or are planning on buying a pet.  

Knowledge is key when entering into the unknown of becoming a Landlord or Tenant.  Knowing what is allowed and not allowed is important for either parties.  Stepping over the boundaries is very easy if you aren't aware of the responsibilities in which the Landlord and Tenant Act require. Prepare yourself prior, therefore if anything does arise during the lease term. Those matters can be handled in a timely and coordinated fashion and without incident.
